CONDITIONS OF PURCHASE

Please read the terms carefully so you know your obligations.

The "player" is the purchaser of the genuinewinner.com roulette system (the "product"). "Genuinewinner.com" includes "The Wheel Analysis Group" and other representatives of Genuinewinner.com.

 

By submitting the purchase agreement and submitting payment, you agree that your purchase is subject to the following terms and conditions.

 

The "product" (also referred to as the "roulette system") consists of:

a. The primordial variants document: an electronic document containing various proven methods to predict the outcome of roulette spins, including the primordial variants, visual ballistics techniques, dealer signature analysis, and wheel bias analysis techniques. Periodic document updates are included free of charge to ensure the techniques are up-to-date with current casino conditions.

 

b. General consulting services, and the development of custom variants which are charts designed to predict the spin outcomes of the specific roulette wheel they were developed for. Custom variants may be generated by secure online software made available to players, or by representatives of genuinewinner.com. They typically incorporate a variety of relatively unknown patterns found in nature, some of the techniques listed in 'a', or a combination of both.

 

c. Formulation of other unspecified customized strategies, that may not fall into either of the categories 'a' and 'b', to predict the outcome of spins of specific roulette wheels.

 

Players also receive free access to the player only forum, and the online custom variant development software. The player only forum is intended for players to share experiences and assist each other, and arrange to meet and form teams. The online custom variant software enables players to perform a wheel analysis and, if patterns are favorable, generate custom variants without the intervention of genuinewinner.com staff. However, these two services are free premiums and do not form part of the product. Genuinewinner.com reserves the right to refuse any player access to these free services for any reason it considers appropriate.

 

Should the player breach any part of this agreement, all ongoing services and support for the player will be withdrawn, including but not limited to the development of custom variants, and refusal of access to the primordial variants document. The player will not be entitled to a refund. Breach may also result in legal action by genuinewinner.com and/or its clients.

 

1. Under no circumstances may the player:

i. Discuss any part of the Roulette System with any third party, or

 

ii. Identify themself to any third party (other than other players on the player only forum) as a client of genuinewinner.com, or

 

iii. Distribute any part of the product, or

 

ii. Disclose any information pertaining to the product to any third party without prior written consent from genuinewinner.com

 

Any and all information pertaining to the roulette system is considered confidential, and the intellectual property of genuinewinner.com, and may not be disclosed to any third party for any reason without prior written consent from genuinewinner.com. Confidential information includes but is not limited to content from the player only forum. The player understands that in attempt to unethically gain information about the roulette system, some individuals may attempt to deceive players by claiming they are also clients of genuinewinner.com. The player may discuss the roulette system only with other verified players, which are only members of the player only forum. Discussions with other players make only take place only on the player forum. The player is liable for any unauthorized disclosure of information or material pertaining to the roulette system, whether intentional or unintentional. Meetings and discussions between verified players (members of the player only forum) may be arranged for the purposes of forming teams and attaining support from each other. The player understands there is a zero tolerance policy for "information leaks" and unauthorized disclosures, as the success of all players, in part, depends on the maintaining of the roulette system's trade secrets.

 

2. The player must not distribute the roulette system or any related information to any third party without prior written consent from genuinewinner.com. Related information includes but is not limited to email transmissions from genuinewinner.com, and content from the player only forum.

 

3. The levels of income stated on the genuinewinner.com web site are based on results achieved by other players and the seller's personal experience. However, irrespective of the success of application by other players, genuinewinner.com does not and cannot offer performance guarantees. As with any business, individual results may vary due to factors beyond genuinewinner.com's control. Such factors include but are not limited to where the roulette system is applied, unit size, and the player's motivation. All express and implied terms, conditions and warranties which otherwise might apply to your purchase of the product are expressly excluded other than those terms, conditions and warranties which by law cannot be lawfully be excluded or modified by agreement including without limitation Part V of the Trade Practices Act 1974 (Cth) and the equivalent provisions of the Fair Trading Act 1999 (Vic).

 

4. The seller asserts that while almost all wheels are "beatable" using one technique or another, all of which form part of the product, successful application of the roulette system may only be considered "practical" on approximately 30-50% of wheels world-wide. This information is an estimate based on information obtained from casinos and players world-wide. Although genuinewinner.com believes this estimate to be accurate, it cannot guarantee accuracy. Genuinewinner.com therefore does not and cannot guarantee the wheels in the player's local casino are suitable. Should the player find that any of the techniques cannot be applied successfully at their casino, the player understands and agrees that it is their sole responsibility to seek suitable wheels. This includes if the player does not reside close to a suitable casino, or any other factors that are beyond genuinewinner.com's control.

 

5. Casino owners or staff, and their immediate family are not permitted to purchase. Some exceptions are permitted at the sole discretion of genuinewinner.com staff.

 

6. Genuinewinner.com will provide all required support, and will develop custom variants for the player. Genuinewinner.com will develop custom variants, although in the event of the death or incapacity of our principal consultants, another representative of genuinewinner.com will develop custom variants. Genuinewinner.com reserves the right to cease the service of custom variant development, although should genuinewinner.com decide to do so, the player will receive access to software capable of developing custom variants for a period of not less than 10 years following the date of purchase. Genuinewinner.com will provide all required support to ensure correct application of the software.

 

7. While many casinos cannot refuse entry to players unless they break the law, most casinos reserve the right to refuse entry to any individual without explanation. Although it is rare, and although genuinewinner.com provides detailed instructions to help prevent detection by casinos, consistent winning players may be banned by some casinos. In such situations, it is the sole responsibility of the player to seek an alternate casino at which to apply the system. Genuinewinner.com is not entitled to provide a refund if a player is banned from any casino.

 

8. The player understands that some elements of the roulette system, namely custom variants, are an analysis of spin results from a specific wheel. The analysis requires that the player collect a minimum of 300 spin results (for analysis) the first time they collect spins, for each wheel they require to be analyzed. At other times, players may only require 30, 60, 90, 120, 150, 180, 210, 240 or 270 spins - or another amount suggested by genuinewinner.com. The spin results will then be analysed by genuinewinner.com staff, or by the player with the online wheel analysis software. The player understands that not always will such an analysis result in the successful development of a custom variant. Although typically approximately 30% of attempts results in a custom variant, genuinewinner.com does not guarantee any analysis will result in the successful development of a custom variant.

 

9. Upon receipt of payment, genuinewinner.com grants the player a non-transferable license to utilize its products and services.

 

10. From time to time we or you may not insist on strict compliance with these Terms and Conditions. However this does not mean that we or you cannot insist on performance on another occasion of any part of the Terms and Conditions or the same part that we may have let go in the past. We reserve the right to amend the agreements at any time, and it shall remain your responsibility to note such changes which are announced on the player forum. Your continued use of the product is subject to any updated terms of service.

 

11. If any part of these terms and conditions is or becomes invalid, that part will be severed from the terms and conditions. This will not affect the validity of the remaining provisions of the terms and conditions.

 

12. The laws of Victoria, Australia apply to these Terms and Conditions and any disputes will be heard in the courts and tribunals of that State.

In plain language, when you become one of my players, you become part of a team. The continued success of the team partly relies on the team's ability to maintain trade secrets. Although "casino counter-measures" almost never make the system "ineffective", if secrets are released, casinos are armed with information that may be used to make system application of the roulette system more difficult. An example is leaked information may assist casinos to identify users of the system. Therefore, players are more likely to be banned - this would inevitably make application more difficult.

 

Although every effort has been made to protect the team from information leaks to casinos, it only takes one wayward player to release information that may harm the team. For this reason, information players receive is on a need to know basis only. Some of the information you need to know is sensitive and needs to remain secret. The downside of such restrictions is that players need to rely on us for the development of custom variants, but the upside is that trade secrets will remain secrets, and therefore the system will likely retain effectiveness and practicality for a long time to come. This is in the best interests of the team.

 

Access to the online custom variant software is free once a player develops a reasonable level of trust with us. This software is a "lite" version of the wheel analysis software we use. While it enables development of custom variants, it does not utilize all possible pattern types to ensure the innermost system secrets are maintained. However, when we come to know and trust a player even better, over time we may release further secrets of custom variants which is done entirely at our discretion.

 

Although most players prefer us to analyse spins for them, some players don't want to need to rely on us. Such players have the following options:

 

i. Use the online custom variant development software: this is a simplified version of our software that develops custom variants. Players can use it to instantly generate custom variants, although they are a "lite" version that don't utilize all pattern types. This software is a free premium, and not an official part of the product, so access to players is granted entirely at our discretion. You do not need to pass any rigorous testing to be given access, only to develop a reasonable level of trust with us which occurs naturally over time.

 

ii. Apply the Primordial Variants: simple and effective methods to win at roulette, but not as effective or practical as custom variants. There are various versions of the primordial variant. Which version you use depends on where you play, and how much time you can dedicate to play.

 

iii. Apply the other methods detailed in the documentation, including but not limited to Visual Ballistics, Bias Analysis, and Dealer Signature Analysis.

 

You receive all the required help and information to beat roulette. While of course you'd like us to guarantee you profits, although our methods are thoroughly proven effective, such a profit guarantee is just not realistic because we have no control over factors like your learning curve, discipline, motivation, where you play etc. However we have every confidence that dedication, correct system application and seeking support where required will ensure your success.

 

Although the clear majority of casinos enable relatively easy and practical application, if you consider play in your local casino to be too difficult or impractical, it is prudent to simply change casinos - you should always aim to play in the easiest conditions possible anyway. And if you seek it, providing you adhere to the agreement, you will always get everything you need. We'll do everything possible to ensure your success, whether it be personal demonstrations and meetings, phone calls, or just emailing back and forth. We care very much about our players and their success and it will not take you long to see this.

CONFIDENTIALITY AGREEMENT

This Agreement is made: BETWEEN: GenuineWinner.com (GenuineWinner.com Pty Ltd, A.C.N 090 739 754), AND the Purchaser ("the Recipient", named in the Purchase request form).

 

RECITALS

A. GenuineWinner.com is a multi disciplinary company with interests in energy research and gambling (“the Business”). GenuineWinner.com has developed computer software and techniques which are designed to analyze spin outcomes of a roulette wheel, which in turn can predict spin outcomes. The software in conjunction with techniques together forms the “the Product”.

B. GenuineWinner.com seeks to enter into commercial relationships with purchasers and international resellers for the distribution and sale of their Product or with other persons or entities including but not limited to potential agents, investors or partners interested in exploiting the Product and employees, contractors, manufacturers and advisors interested in joining or assisting the Business.

C. The Recipient wishes to enter into discussions to form a Commercial Relationship with GenuineWinner.com.

D. During these discussions there will be the disclosure of Confidential Information about the Product and the Business including design ideas and concepts which has a unique value to GenuineWinner.com.

E. GenuineWinner.com will be prejudiced by any unauthorized use or disclosure of the Confidential Information.

F. The parties agree to disclose and use the Confidential Information as provided in this Agreement.

 

THE PARTIES AGREE as follows:

 

Definitions and interpretation

1. In the construction of this Agreement, unless the contrary intention appears:

 

‘Approved purpose’ means evaluation by the Recipient of GenuineWinner.com and the Business to decide whether or not to purchase the Product or whether or not to enter into a Commercial Relationship with GenuineWinner.com in relation to the Business.

 

‘Confidential information’ means all information provided by GenuineWinner.com or its employees, agents, officers or advisers to the Recipient including:

 technical information, designs, software, photographs, drawings and written work including instructional manuals;
 trade secrets, including ideas, know-how and business concepts not reduced to material form;
 business plans, systems, policies and procedures;
 market information;
 marketing material including website content;
 commercial information about GenuineWinner.com or persons with whom GenuineWinner.com deals, including details of agreements with employees, contractors, customers and others;
 financial information about GenuineWinner.com including pricing structures;
 all intellectual property including registered and unregistered trademarks, designs and work to which copyright applies;
 any information marked “confidential” or which GenuineWinner.com informs the Recipient is confidential or a trade secret;

 

but excluding:

 

 information available to the public (other than through disclosure by the Recipient or by a person to whom the Recipient disclosed the Confidential Information);
 information which the Recipient can prove it lawfully possessed before obtaining it in connection with this Agreement;

 

‘Regulatory Body’ means any Federal or State Minister of the Crown, government or quasi government agency or statutory authority whose approval or consent is necessary for the Approved Purpose.

 

 

Value and ownership

 

2. The Recipient acknowledges that all of the Confidential Information will at all times remain the absolute property of GenuineWinner.com.

 

 

General obligation

3. The Recipient must take all steps necessary to safeguard the confidentiality of the Confidential Information.

 

 

Particular obligation

4. The Recipient may use the Confidential Information only:

(1) for the Approved Purpose; or

(2) to the extent and for a purpose to which GenuineWinner.com has consented in writing.

 

 

Restrictions

 

5. Without limiting the generality of the above Clauses, the Recipient MUST not:

 

(1) profit or cause any other person to profit from the use of the Confidential Information, except in respect of the Approved Purpose;

 

(2) develop or cause any other person to develop any business idea, enterprise, Product or services based on the Confidential Information without GenuineWinner.com’s consent in writing; and

(3) use or disclose to a third party any aspect of the Confidential Information for the purpose of contacting or contracting with any employee or client of GenuineWinner.com.

 

 

Permitted Disclosures

 

6. The Recipient may disclose the Confidential Information only:

(1) to a person, including any and all of its employees, agents, officers or advisers if:

(a) the Recipient has informed that person of the confidential nature of the Confidential Information; and

(b) that person has undertaken in writing to GenuineWinner.com to keep the Confidential Information secret and confidential, on the same terms as those in this Agreement; and

(c) it is necessary for the Recipient to disclose the Confidential Information for the Approved Purpose; or

(2) to the extent and for a purpose to which GenuineWinner.com has consented in writing; or

(3) to the extent required by law.

 

 

Printing and Reproduction

 

7. The Recipient may copy or print the Confidential Information only if GenuineWinner.com has consented in writing.

 

 

Communication with Regulatory Body

8. The Recipient may communicate with a Regulatory Body about the Approved Purpose or the Confidential Information only if GenuineWinner.com has consented in writing.

 

 

Security

9. The Recipient must

 

(1) keep all the Confidential Information in a secure manner.

 

(2) immediately report to GenuineWinner.com any unauthorized use, disclosure, copy or printing of the Confidential Information of which the Recipient becomes aware.

(3) use its best efforts to obtain the return or destruction or deletion of any unauthorized copy or print-out of the Confidential Information.

 

 

Return and Destruction

10. On demand by GenuineWinner.com, the Recipient must:

(1) deliver to GenuineWinner.com all the Confidential Information in the Recipient's possession or control;

(2) delete all the Confidential Information held electronically in any medium in the Recipient's possession or control; and

(3) destroy all documents which were prepared by or for the Recipient and which were based wholly or partly on the Confidential Information, and delete all such documents held electronically in any medium in the Recipient's possession or control.

 

Claims in case of Breach

 

11. GenuineWinner.com reserves the right to make claims for all remedies available to it against the Recipient in relation to any losses or damage suffered by GenuineWinner.com should the Recipient commit any breach of this Agreement. In addition, supply of all access codes to software will be immediately terminated.

 

 

Injunctive relief

 

12. In the event of a breach or threatened breach of this Agreement, GenuineWinner.com is entitled to injunctive relief in addition to any other remedies available at law or in equity, without showing or proving any actual damage sustained by GenuineWinner.com due to the breach or threatened breach.

 

Continuing obligations

 

13. The obligations of the Recipient under this Agreement survive the completion of the Recipient’s evaluation of the Business as well as the completion of any agreement in respect of the Approved Purpose, except as otherwise provided by such an agreement.

 

 

Licence Rights

 

14. This Agreement does NOT grant the recipient any licence rights or other rights relating to the Business. Any rights must be detailed in a separate Agreement and signed by both parties.

 

No Assignment

 

15. The Recipient must not assign all or any of its rights or obligations under this Agreement without the prior written consent of GenuineWinner.com.

 

Applicable law

 

16. This Agreement is governed by the law of the State of Victoria, Australia and the parties submit to the non-exclusive jurisdiction of the courts of that State.

 

No warranties

17. GenuineWinner.com makes no warranty or representation that the Confidential Information:

(a) is fit for any general, or any particular purpose; and

(b) does not infringe the rights of any other person.

 

Amendments

 

18. We reserve the right to amend the agreements at any time, and it shall remain your responsibility to note such changes which are announced on the player forum. Your continued use of the product is subject to any updated terms of service.

 

 

Severability

 

19. If any provision of this Agreement is held to be unlawful, invalid, unenforceable or in conflict with any rule of law, statute, ordinance or regulation, it is to be severed so that the validity and enforceability of the remaining provisions are not affected.

 

 

Acceptance of Terms

 

20. Each party agrees to be bound by the terms of this Agreement. The Recipient by submitting the purchase form, this Agreement is deemed to have read and understood its terms and to have sought legal advice from an independent legal adviser as to the matters in issue. Should the Recipient elect not to seek independent legal advice, the Recipient by signing this Agreement hereby waives its right to seek same and forever indemnifies GenuineWinner.com from any claim arising from misinterpretation or misunderstanding of the terms of this Agreement.
